Payless keeps your personal information for no longer than is reasonably necessary or required by law. How long we keep it depends very much on the type of information and purpose.

The criteria we use to determine the retention period for certain categories of data is as follows:

  • the length of time that you are a member of Payless loyalty program or any other loyalty scheme that we operate or a member of any corporate programme;
  • how frequently you rent with us or when you most recent rental occurred;
  • whether there are contractual or legal obligations that exist that require us to retain the data for period of time;
  • whether there is any ongoing legal claim that relates to any rental you have made with us, or that is otherwise related to your relationship with us;
  • whether any applicable law, statute, or regulation allows for a specific retention period;
  • whether the personal information is considered to be a special category of personal information, in which case a shorter retention period generally would be applied; and
  • what the expectation for retention was at the time the data was provided to us.

As we offer the ability to rent vehicles and benefit from our services in many locations globally, we will transfer your personal information to ABG, its affiliates, independent licensees and travel agents in these locations for the purposes of fulfilling your rental request and/or entering into a rental agreement.  The exact location of where your personal data will be transferred depends on the location of your rental.

Many of the countries to which your personal information may be transferred for these purposes that are located outside the EU do not benefit from an adequacy decision issued by the EU Commission regarding protection afforded to personal information in that country.

These transfers are made either as they are necessary for the performance of a contract to which you will be a party, or for pre-contractual measures.  Alternatively, adequacy of data protection is ensured by standard data protection clauses that ABG has in place with the relevant recipient.

Business operations

In addition, the information we collect from you may be transferred to, and stored by, IT vendors who operate on our behalf.  In particular, these include ABG booking engine hosting provider that is located in the United States.  We also transfer information to a number of providers of business application - such as CRM, marketing applications, as well as eSign service provider.   These providers are primarily located in the EU and the United States.

The United States does not benefit from a decision issued by the EU Commission regarding protection afforded to personal information.  Adequacy of data protection is instead ensured by standard data protection clauses ABG has in place with that third party.

Given the global nature of ABG’s business, we also transfer information within the group companies of Avis Budget Group, Inc as for certain activities the group uses shared IT functions.  Transfers from within the European Union for these purposes are primarily made to the United States, although transfers may be made to other countries as well.  The United States and many of the other countries located outside the European Union do not benefit from an adequacy decision issued by the EU Commission regarding protection afforded to personal information in that country.  Adequacy of data protection is instead ensured by standard data protection clauses ABG has in place with the recipient.

Turning off and deleting cookies

All web browsers allow you to limit cookie behaviour or turn off cookies within the settings or options of the browser. The steps to do this are different for each browser, you can find instructions under the Help menu of your browser.

Through your browser you can also view the cookies that are on your computer, and delete individual ones, or purge them all.

Cookies are just text files so you can open them and read the contents. The data within them is often encrypted, or a numerical key corresponding to a web session so they often don't make sense to anything other than the website that wrote it.

If you turn off cookies, the Payless site will not be able to create a reservation. Disabling cookies will also affect the monitoring of your progress through the site, but will not stop the analytics code from recognising your visit.

What cookies does the Payless site create?

The session cookies that Payless writes includes data used by the web server hardware about which server is processing your session, your authentication status (against the Payless customer database) and the details of your reservation.

The persistent cookies that are created by the Payless website are used by our technology partners. They are used to recognise traffic to the site that is returning users rather than new customers. The information that is stored is used to serve you appropriate adverts on other sites on our behalf. Deleting these cookies won't affect your experience or the functionality of the Payless website.
